1. Purpose of the Service
1.1. The platform known as “ServiceHub,” owned by Hublance Inc. (“Hublance”), is designed to facilitate connections between companies seeking services in the Human Resources Information Systems (HRIS) sector and specialists capable of executing projects, temporary missions, or permanent roles.
1.2. ServiceHub functions solely as a technological intermediary that enables connection and communication between parties, without assuming responsibility for contractual agreements or outcomes derived from such relationships.
2. Territorial Scope
2.1. ServiceHub is available globally and may be used by users located in any country, subject to applicable local laws.
2.2. Access to and use of ServiceHub imply acceptance that all legal disputes will be governed by the laws of the European Union and, where applicable, the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
3. Official Language
3.1. The platform and these terms are written in English, which shall be considered the official language for all purposes related to the use of the service.
3.2. Translations into other languages are for informational purposes only and shall not have legal value.
4. Compliance with International Regulations
4.1. ServiceHub complies with the General Data Protection Regulation (GDPR) of the European Union and the California Consumer Privacy Act (CCPA), both of which apply complementarily when relevant.
5. Admitted User
5.1. The following may register on the platform: a) End clients: companies seeking HRIS services or consulting. b) Consulting firms and recruitment agencies. c) Freelance consultants specializing in HRIS.
5.2. All users must be at least 18 years old and legally capable of entering into binding contracts.
6. Registration Process
6.1. Registration on the platform requires providing: a) Verifiable personal and professional information. b) Previous work experience and professional references. c) Key skills and project preferences, including: i. Availability (full-time, part-time, specific hours). ii. Desired project types (freelance, temporary, permanent).
6.2. Hublance reserves the right to request additional documentation to verify a user’s identity or experience.
7. Permitted and Prohibited Uses
7.1. The following are strictly prohibited: a) Engaging in unfair competition. b) Sending spam, distributing inappropriate content, or unsolicited advertising. c) Uploading false, defamatory, or misleading information. d) Using the platform for activities contrary to the law or these terms.
8. Fee and Payment Model
8.1. Fees for end clients and consultants will be agreed upon individually, including an additional fee payable to Hublance for platform use.
8.2. Service prices are valid for a period of 60 days unless otherwise specified.
8.3. Payments are accepted in the following currencies: Euros, U.S. Dollars, British Pounds, Polish Zlotys, Czech Korunas, Swiss Francs, Japanese Yen, Mexican Pesos, Argentine Pesos, Brazilian Reais, Colombian Pesos, Chinese Yuan, and Turkish Lira.
9. Payment and Collection Policy
9.1. Clients are required to make payments upon delivery of the agreed work.
9.2. Consultants will receive their fees between 3 and 21 days after service delivery, depending on the project type and agreed terms.
10. Dispute Resolution and Refunds
10.1. In case of conflicts, parties must escalate the case to a formal dispute within the platform.
10.2. Refunds will only be considered if the affected party justifies non-compliance with the agreement.
11. Intellectual Property
11.1. All content generated by consultants for clients will be the exclusive property of the clients unless otherwise expressly agreed.
12. Privacy and Security
12.1. Hublance is committed to complying with the highest data protection standards, including GDPR and CCPA, to safeguard users’ sensitive information.
12.2. Information will only be shared with third parties when strictly necessary for platform operations or as required by law.
13. Limitation of Liability
13.1. Hublance assumes no responsibility for compliance with agreements between clients and consultants, limiting its role to connecting both parties.
13.2. Hublance does not guarantee the quality or outcomes of services contracted through the platform.
14. Suspension and Account Termination
14.1. Users may freely cancel their accounts at any time.
14.2. Hublance may suspend or delete accounts in cases of: a) Violation of these terms. b) Inappropriate conduct, including defamation, insults, or spam. c) Improper use of the platform, such as unauthorized advertising or illegal activities.
15. Applicable Law
15.1. These terms will be interpreted and enforced in accordance with the laws of the European Union.
15.2. Any dispute will be submitted to competent courts within the European Union unless otherwise stipulated by law.
16. Modifications to Terms
16.1. Hublance reserves the right to modify these terms at any time. Changes will be notified to users via email and internal communications on the platform.
17. Assistance and Support
17.1. The ServiceHub project team will be available for: a) Ticket tracking. b) Ensuring service quality. c) Assisting users in resolving technical issues. d) Act as an intermediate to ensure regulatory compliance and security at each stage of the process.
18. Acceptance of Terms
18.1. Registration and continued use of the platform imply express acceptance of these terms and conditions.
